The following terms and conditions stated below will act as a legal agreement between you and Wridz, a Texas based LLC. PLEASE READ THE ENTIRE AGREEMENT BEFORE USING THE Wridz APPLICATION OR SERVICES.
Your use of the Wridz application or services constitutes your agreement and understanding to be bound by these Terms and service as a contract between you and Wridz. If you are not in agreement of these Terms you are not granted access to the Wridz apps or services. Wridz reserves the right to cancel this agreement at any time for any reason. Wridz will from time to time update or edit these terms. Any revisions of these terms will be posted to the agreement on the Wridz website (wridz.com) and shall supercede any previous terms or conditions.
Wridz DOES NOT PROVIDE TRANSPORTATION AND IS NOT A TRANSPORTATION COMPANY. Wridz provides a service consisting of a web based platform where a person seeking transportation can be linked to a third party driver offering a ride. Through the Wridz app a rider can request and schedule transportation as well as pay for said transportation and the third party driver can accept the request and be paid for supplying the ride. You acknowledge that the transportation provided to rider is by an independent third party driver that is in no way employed by or controlled by Wridz. STREET HAILING A TRIP IS STRICTLY PROHIBITED. Cash payment for transportation is prohibited. All fares must be paid through the app with a credit/debit card on file.
Upon acceptance and compliance of the entire terms and conditions described herein, Wridz shall grant you a non-exclusive, revocable, limited license to access and use the Wridz app on your computer or personal mobile device for personal, non-commercial use limited to your use of our service.
You are not entitled to remove, reproduce, modify, distribute, lease, sell, resell, transfer, license, display or otherwise use the service except as permitted by this agreement. You may not use any information pertaining to or derived from Wridz apps for any purpose other than using the service unless written permission is expressly granted. All rights and services therein will remain the sole property of Wridz. These terms or your use of service do not entitle you to any rights related to service except for the limited license granted by this agreement.
To use the Wridz app you must register as a user through the Wridz website. You must create a user account and attest that you are at least 18 years old. You must provide ALL information requested on the user application to be granted access to the service. You must update and keep current all information including but not limited to payment information on your account. You will be solely responsible for all activity on your account including secrecy and privacy of account information and security passwords. This service is not available for persons under 18 years of age. Anyone under the age of 18 seeking transportation must be accompanied by a person of legal age listed as an account holder. You may be asked to provide proof of identity before services are rendered. If you do not comply you may be denied service.
This account is non-transferable. All applicable conditions and laws must be complied with at all times. Including but not limited to use of service for only lawful purposes. You may not use this service to cause inconvenience, annoyance, property damage or any other acts deemed to be intolerable to any person or property whether related to this service or not.
When creating a user account you agree to receiving communication from Wridz whether for use of services requested or for survey or promotional reasons. This communication may be through text messages, email or phone.
For use of Wridz services, the user must maintain their own data network access. If any text or data rates apply they are the sole responsibility of the user and Wridz is not liable for any charges to user. Wridz will not be held liable for any failures of communications whether on the Wridz service site or on the user's portion of communication.
Upon request for transportation, the user will be quoted the estimated applicable fare for the ride predetermined and agreed to by the third party driver. By proceeding with the request the user agrees to the estimated fare. Once the ride is complete the driver will initiate the payment process using the actual calculated fare. The payment will be collected by Wridz on behalf of the third party driver through the payment method provided by the user on their Wridz account. All payments are due and payable upon completion of the requested ride. All charges are final and non-refundable unless deemed otherwise by Wridz. All cancellations for requesting a ride must occur before the third party driver arrives at requested pick up point. A cancellation fee for late cancellation will occur in the event a ride is declined by rider. Each vehicle is inspected and approved or rejected by Wridz. Our policy is no vehicle larger than an occupancy of 7 is approved. Occupancy in a vehicle for transportation requested by a passenger with guests will be limited to the number of seat belts in the drivers vehicle with a maximum of 7 belts (1 driver and six passengers). All occupants of the vehicle must have a seat belt available.
In the event that you cause any damages, or extra cleaning is necessary to a third party's vehicle, other than what is considered normal wear and use by you, you agree that payment will be facilitated through the payment method listed on your account for this damage or cleaning. Excess damage will be determined by Wridz, at the driver's request, and you will be notified of any charges related to this damage.
ALL OF Wridz SERVICES ARE OFFERED ON AN AS AVAILABLE SERVICE. Wridz CLAIMS NO WARRANTIES, IMPLIED OR OTHERWISE, UNLESS ADDRESSED DIRECTLY IN THESE TERMS AND CONDITIONS. Wridz DOES NOT GUARANTEE AVAILABILITY, RELIABILITY, QUALITY OF SERVICE PROVIDED. Wridz DOES NOT GUARANTEE AGAINST SERVICE INTERRUPTION OR TIMELINESS OF RIDE. ANY AND ALL RISK LIES SOLELY WITH YOU AS THE RIDER/USER OF THIS SERVICE AS ALLOWED BY LAW. ALL DRIVERS USING THE WRIDZ PLATFORM MUST ABIDE BY, AND STAY COMPLIANT, TO THE LAWS OF THE STATE THAT SERVICE IS BEING PROVIDED.
Wridz SHALL NOT BE LIABLE FOR ANY DAMAGES WHETHER DIRECT, INDIRECT, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL. THIS INCLUDES PERSONAL INJURY, LOST REVENUE, OR PROPERTY DAMAGE RELATED TO DIRECTLY OR INDIRECTLY FROM THE USE OF Wridz SERVICES. FURTHERMORE Wridz WILL NOT BE HELD LIABLE FOR ANY LOSS OR DAMAGE THAT MAY ARISE AS RESULT FROM THE TRANSACTION BETWEEN YOU AND THE THIRD PARTY DRIVER. Wridz DOES NOT IMPLY THAT THIRD PARTY DRIVERS HAVE ANY SPECIAL QUALIFICATIONS TO PROVIDE TRANSPORTATION OTHER THAN A VALID DRIVER'S LICENSE IN THE STATE OF TEXAS. Wridz IN NO WAY WARRANTS THE PERFORMANCE OF THE THIRD PARTY DRIVER.
YOU ACKNOWLEDGE THAT THOUGH Wridz PERFORMS DRUG SCREENING AT THE TIME OF A DRIVER'S INTERVIEW, Wridz WILL NOT BE HELD LIABLE FOR ANY TYPE OF DRUG USE OR ABUSE BY THE THIRD PARTY DRIVER POST INTERVIEW.
Wridz DOES NOT TOLERATE DISCRIMINATION BASED ON RACE, COLOR, RELIGION, NATIONAL ORIGIN, DISABILITY, SEXUAL ORIENTATION, SEX, MARITAL STATUS, AGE OR ANY OTHER CHARACTERISTIC PROTECTED UNDER APPLICABLE FEDERAL OR STATE LAW. ANY DRIVER OR RIDER FOUND TO BE IN VIOLATION OF THIS STANDARD WILL HAVE THEIR ACCOUNT DEACTIVATED AND BE PROHIBITED FROM USING THE Wridz PLATFORM.
STATE AND FEDERAL LAW DICTATE THAT TRANSPORTATION ARRANGED THROUGH APPLICATIONS BY PASSENGERS WITH SERVICE ANIMALS CANNOT BE DENIED STRICTLY ON THE BASIS OF THE ANIMAL. THERE IS NO EXCEPTION FOR ALLERGIES, RELIGIOUS OBJECTION, OR FEAR OF ANIMALS. PASSENGERS THAT FEEL THEY HAVE BEEN DENIED SERVICE STRICTLY BECAUSE OF SERVICE ANIMALS MAY USE THE "HELP" TAB ON THE APP TO REPORT. THERE ARE NO EXTRA CHARGES FOR TRIPS REQUESTED AND COMPLETED BY DRIVERS ON THE Wridz PLATFORM WHICH REQUIRE SPECIAL EQUIPMENT DUE TO DISABILITY. BECAUSE OF ACCESSIBILITY REQUIREMENTS Wridz MAY REFER YOU TO ANOTHER SERVICE THAT PROVIDES THE APPROPRIATE VEHICLE ACCESSIBILITY REQUIREMENTS WHERE Wridz IS NOT ABLE TO SAFELY PROVIDE IT. THERE ARE NO CHARGES FOR THIS SERVICE WHERE REQUIRED. Wridz IS IN NO WAY RESPONSIBLE OR LIABLE IN ANY WAY FOR ANY ACTIONS OR INCIDENT THAT OCCURS IF YOU USE THE REFERRED PROVIDER.
FURTHERMORE YOU AGREE TO HOLD HARMLESS AND INDEMNIFY Wridz AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, LIABILITIES AND EXPENSES ARISING OUT OF USE OF THE Wridz SERVICE.
You further agree that any claim or dispute arising from use of Wridz services will be settled by binding arbitration between you and Wridz. You are hereby agreeing to waive your right to a trial by jury or to participate as a plaintiff in any class action proceeding.
These terms and conditions may not be assigned by you without the written permission of Wridz. Wridz may assign these terms without your consent to a subsidiary or any entity deemed suitable by Wridz. These terms and conditions in no way represent any joint venture, partnership or relationship between you and Wridz or the third party driver as a result of this agreement.
